Frontier Dispute Case (Burkina Faso/Mali), 1986 I.C.J. 554
How are international borders established for a newly decolonized country? In Frontier Dispute Case (Burkina Faso/Mali), the International Court of Justice, or ICJ, turned to the international law principle of uti possidetis juris to answer this question and settle a dispute between two newly independent African nations.
In 1960, the Republic of Mali and Burkina Faso, formerly known as the Republic of Upper Volta, gained independence from France. In 1964, the Conference of African Heads of State and Government convened. At the conference, member countries, including Mali and Burkina Faso, agreed to the Charter of the Organization of African Unity, which held that the newly independent African countries would respect the frontiers, or historical boundaries, that existed at the time of independence. This pledge represented a formal acceptance of the international law principle known as uti possidetis juris, which holds that the boundaries of colonies are preserved when the colonies become independent countries. In the 1970s, multiple armed conflicts erupted between Mali and Burkina Faso as part of a territorial dispute over one hundred miles of land known as the Agacher Strip.
In 1983, Mali and Burkina Faso submitted a mutual agreement to the ICJ for a binding judgment to establish the border in the disputed area.
